Terms of Service

These Terms of Service ("Terms") are an agreement between you and RN Chidakashi Technologies Pvt. Ltd. ("Chidakashi", "we", "us") for your use of Chidakashi Kavach: the website at safety.chidakashi.ai, the dashboard, the API at api.safety.chidakashi.ai and the Kavach SDKs (together, the "Service").
If you use the Service on behalf of an organization, you agree to these Terms for that organization, and you confirm you're authorized to do so. "You" then means both you and that organization. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. The Service
Kavach is a content safety service. You write safety rules in plain language ("policy sets"), and the Service checks text and images against them and returns a verdict (such as block, pass or unknown) and, if you ask, a reason. You can use it through the dashboard, the API and the SDKs.
We may change, add or remove features over time. If we remove a significant feature you rely on, we'll try to tell you in advance.
2. Accounts and organizations
- You must be at least 18, and give accurate information when you sign up.
- Your account belongs to an organization, which can have several members and several projects. The organization's Owners and Admins manage its projects and billing.
- You're responsible for everything done under your account and your organization's projects, including by the members you add.
- Keep your password secure. Tell us at once if you think your account has been used without permission.
3. API keys
- API keys give access to a project. Keep them secret, and use them only from your own servers, never in a web page or a mobile app.
- You're responsible for all use of your API keys, including use by anyone who obtains them. Revoke a key straight away if you think it's been exposed.
4. Credit, prices and payment
- Prepaid credit: the Service is paid for with prepaid credit, held by your organization and shown in US dollars. Each check uses credit according to the processing it needs, at the prices shown on the dashboard's Usage page. Saving policy sets doesn't use credit.
- Free credit: new organizations may receive some free credit to try the Service. It has no cash value.
- Running out: when your credit runs out, checks are refused until you add more. Checks already in progress may still be charged, so the balance can go slightly below zero; new credit covers that first.
- Payment: purchases are made through our payment provider. Prices are exclusive of taxes, which are added where applicable.
- Refunds: credit is non-refundable, except where the law requires otherwise, or where we decide otherwise for a billing error.
- Changes: we may change prices. Changes apply to checks made after they take effect, and we'll give you notice before a price increase.
5. Your content
- Your content: "Customer content" means the policy sets, text and images you or your applications send to the Service, and the verdicts and reasons returned for them.
- Ownership: you keep all rights in your customer content. You give us permission to host, process and transmit it as needed to provide, secure and improve the Service for you, as described in our Privacy Policy.
- Your responsibility: you're responsible for your customer content and for having the rights and any consents needed to send it to us, including for any personal data about your users. You'll comply with the data protection laws that apply to you.
- Harmful content is expected: the Service exists to check content that may be harmful, so sending such content in order to check it is allowed. Don't use the Service to store, distribute or create harmful content, though.
6. Acceptable use
You agree not to:
- use the Service for anything illegal, or to harm or harass anyone
- send content that it's illegal for you to possess or share, such as child sexual abuse material, except as the law expressly permits for reporting or moderation
- try to get around rate limits, credit checks or other limits, or use someone else's account or API keys
- disrupt, overload or attack the Service, or try to access it or its data without permission
- reverse engineer, copy or extract the Service's models, prompts or methods, except where the law allows it
- resell or provide the Service to others as a standalone product without our written agreement
- use the Service to build a competing product
We may investigate suspected misuse, and suspend access while we do.
7. Verdicts are automated
The Service uses AI models to reach its verdicts. They can be wrong: content that breaks your rules can be passed, and content that doesn't can be blocked. An unknown verdict for an image means the image couldn't be judged, and isn't a pass.
You're responsible for how you use the verdicts, including deciding what happens to your users' content, deciding what happens when a check fails or is unavailable, and using human review where the impact of a decision calls for it. The Service doesn't replace your own judgment, or legal advice about your obligations.
8. Availability and support
We aim to keep the Service available and reliable, but we don't guarantee that it will be uninterrupted or error-free. It may be unavailable at times, for example for maintenance or because of problems with our providers. Unless we agree otherwise in writing, there's no service level commitment. 9. Feedback
If you give us suggestions or feedback about the Service, we may use them without any obligation to you.
10. Confidentiality
Each of us will keep the other's non-public information that's shared in connection with the Service confidential, use it only for the purposes of these Terms, and protect it with reasonable care. This doesn't cover information that's public, already known, independently developed, or that must be disclosed by law.
11. Our intellectual property
The Service, including its software, models, prompts, documentation and branding, belongs to Chidakashi and its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while they're in effect. They don't transfer any other rights to you.
12. Suspension and termination
- You can stop using the Service, and delete your organization, at any time.
- We may suspend or end your access if you break these Terms, if your use creates a risk to the Service or to others, if we're required to by law, or if we stop offering the Service. Where reasonable, we'll give you notice first.
- When your access ends, your right to use the Service ends, and we may delete your organization's data as described in our Privacy Policy. Any unused credit is lost, unless the law requires otherwise or we end your access without cause, in which case we'll refund the unused paid credit.
- Sections 5, 7, 9, 10, 11, 13, 14, 15 and 17 continue to apply after these Terms end.
13. Disclaimer
To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
14. Limitation of liability
To the extent the law allows:
- Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from these Terms or the Service.
- Our total liability for all claims arising from these Terms or the Service is limited to the amount your organization paid us for the Service in the 12 months before the claim arose.
These limits don't apply to liability that can't be limited by law.
15. Indemnity
You'll defend and indemnify Chidakashi against claims, losses and costs (including reasonable legal fees) arising from your customer content, your use of the Service, how you use its verdicts, or your breach of these Terms or of applicable law.
16. Changes to these Terms
We may update these Terms from time to time. If we make significant changes, we'll tell you by email or in the dashboard before they take effect. The date at the top shows when they were last updated. Continuing to use the Service after a change means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of India. The courts in Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising from them or from the Service. Before going to court, we'll each try in good faith to resolve the dispute by discussion.
18. General
- Entire agreement: these Terms, together with our Privacy Policy and any written agreement we sign with you, are the whole agreement between us about the Service. If a signed agreement conflicts with these Terms, the signed agreement wins.
- Assignment: you may not transfer these Terms without our consent. We may transfer them to a successor, such as after a merger or acquisition.
- Severability: if part of these Terms can't be enforced, the rest still applies.
- No waiver: not enforcing a right isn't giving it up.
- Force majeure: neither party is liable for delays or failures caused by events beyond its reasonable control.
